Nav Canada’s intent to implement Tentative Agreement

Recently the Local was advised how Nav Canada intends to implement part of the tentative settlement should it be ratified by the membership. Specifically, regarding the removal of LOUs 4-2 and 5-20 and the 3.5% general wage increase effective dates.
Nav Canada intends to implement the 3.5% general wage increase in year one in the following manner.
- Employees who are not in receipt of a Competency Premium under LOU 4-20 or LOU 5-20 as of December 31, 2023 would receive the additional 3.5% general wage increase effective January 1, 2024
- Employees who are in receipt of Competency Premium under LOU 4-20 or LOU 5-20 as of December 31, 2023 would receive the additional 3.5% general wage increase effective as of the date of ratification. The 5% premium they received between January 1, 2024 and the date of ratification would not be “ clawed-Back “
In both circumstances described above, the new 3% top step at all levels would be effective January 1, 2024, as previously agreed.
The Local does not agree with this implementation scheme as that was not the understanding of the negotiating team at the time of signing the memorandum of settlement. Should the company move to implement the tentative agreement in this manner the Local reserves the right to grieve.
